Regulatory authorities

Each canton designates the authority responsible for supervising pension institutions headquartered in its area. This authority will now be structured as a state institution with its own legal personality to take account of the Pillar 2 structural reform and to strengthen its independence.

In the canton of Bern, the previous foundation supervisory authority was separated from the Amt für Sozialversicherung und Stiftungsaufsicht (ASVS, office for social security and supervision of foundations) on 1 January 2012 and transferred to the Bernische BVG- und Stiftungsaufsicht (BBSA, Bern BVG and foundation supervisory authority).

The BBSA monitors observance of legal requirements for pension funds, in particular by checking that the conditions in the regulations comply with legal requirements and approving articles of association. It requires a copy of annual reports, monitors the business activities of pension funds, examines auditors’ reports and those of occupational pension experts and, where necessary, also takes measures to correct deficiencies.
