The Swiss Federal Act on Occupational Retirement, Survivors’ and Disability Pension Plans (BVG) regulates the organisation of pension funds. All pension funds wishing to provide occupational pensions pursuant to BVG must be entered in the register for occupational pension funds. The regulatory authorities responsible maintain such a register for the pension funds under their jurisdiction.
In order to register, funds must comply with the material and formal requirements pursuant to BVG, i.e. pension funds must provide statutory benefits and levy the contributions necessary to do so.
Pension funds may take any of the following legal forms:
Alongside bodies governed by public law, which are reserved for communities
and public institutions, foundations have proven to be an appropriate legal form for
pension funds (according to pension fund statistics, some 98% of all existing private pension funds take the form of a foundation).
